General 2.1 The Website is owned and managed by the Company. For any questions and/or clarifications and/or inquiries, you may contact the Company's customer service directly via email at hotel@kmc.co.il. 2.2 Wherever the masculine form is used in these Terms, it also refers to the feminine. 2.3 These Terms regulate the relationship between the Company and the Visitor and/or Purchaser and shall apply to every order of a product and/or service presented by the Company. 2.4 Use of the Website and any content or service therein is the sole and full responsibility of the User, and the Company shall not be held liable for any direct or indirect damage caused to the User or any third party. 2.5 Any visitor or purchaser declares, by performing any action, that they have read, understood, and agreed to all the provisions and conditions of these Terms and that they will not have any claim and/or demand and/or lawsuit against the Website and/or Company. 2.6 The Company reserves the right to change these Terms from time to time at its sole discretion, without prior notice. The binding version shall be the version published on the Website at the time of placing the order. 2.7 The Company's non-enforcement of any provision of these Terms shall not be considered a waiver or consent to a repeated breach. 2.8 If any provision is determined by an authorized body to be unenforceable or invalid, this shall not affect the validity of the remaining provisions. 2.9 The Company does its best to ensure that the information presented on the Website is accurate; however, inaccuracies or errors may occur in good faith, and the Company shall not be held liable for them.
Placing an Order and Customer Details 3.1 A User wishing to purchase services through the Website must register and fill out a registration form with their personal details, including name, ID number, address, phone number, and credit card information. 3.2 The Company will only use customer details in accordance with the Website's Privacy Policy. 3.3 Providing all required details is a prerequisite for completing the order. Incorrect details may prevent the processing of the order, and the Company shall not be held liable in such cases. 3.4 After placing an order, the Company will verify the credit card details. Upon approval from the credit company and Company verification, an order confirmation will be sent. 3.5 Only an email or other electronic confirmation containing order details, description of services/products, payment amount, and credit card approval shall bind the Company. This confirmation will serve as conclusive evidence of the order. 3.6 Submitting false information is a criminal offense, and legal action will be taken. 3.7 If the transaction is not approved by the credit company, the User will be notified and asked to provide a new payment method. In such cases, the Company reserves the right to cancel the order.
Order Cancellation Policy 4.1 Order cancellations shall be made on the Website after an order has been placed and confirmed ("Order Cancellation"). 4.2 For bookings until 28.2.2020: cancellations made by the Purchaser at least 24 hours before the reservation date will not incur cancellation fees. 4.3 For bookings from 1.3.2021 onwards: cancellations made at least 72 hours prior to the reservation date will not incur cancellation fees. 4.4 Cancellations made less than 24 hours before the reservation date will incur a cancellation fee of 100% of the cost of the first night. 4.5 If the Purchaser was charged for canceled services, they will be refunded to the same credit card used for the transaction, with no cancellation fees deducted.
Intellectual Property Rights 5.1 These Terms grant Users permission to participate on the Website only under these conditions. All intellectual property rights, including copyrights, designs, methods, and trade secrets on the Website and its content, belong solely to the Company. 5.2 The name "Kfar Maccabiah" and its trademarks (registered or not) belong solely to the Company. Any use requires prior written consent. 5.3 Unless explicitly stated otherwise, the content of the Website is for personal, non-commercial use. No license or consent is granted to use any content without prior written permission. Copying, distributing, selling, marketing, or translating any content, including trademarks, images, and designs, is prohibited without the Company's consent.
